FREQUENTLY ASKED QUESTIONS
General Personal Injury Questions
Nothing upfront. We handle all personal injury cases on a contingency fee basis, which means you pay no legal fees unless we successfully recover compensation for you. Your initial consultation is completely free with no obligation.
In Texas, the statute of limitations for most personal injury cases is two years from the date of the accident or injury. However, there are exceptions, and some cases have shorter deadlines. It’s crucial to contact a lawyer as soon as possible to protect your rights.
Texas follows a “modified comparative negligence” rule. You can still recover compensation as long as you were 50% or less at fault. However, your compensation will be reduced by your percentage of fault. For example, if you’re found 20% at fault, your recovery will be reduced by 20%.
Every case is unique. The value depends on factors including the severity of your injuries, medical expenses, lost wages, pain and suffering, and the defendant’s degree of fault. During your free consultation, we’ll review your case and provide an honest assessment.
Insurance companies often make quick, low-ball settlement offers hoping you’ll accept before you understand the full extent of your injuries. Never accept a settlement without first consulting an experienced personal injury lawyer. Once you accept, you typically cannot seek additional compensation later—even if your injuries turn out to be more serious than initially thought.
You may still have options. Depending on your situation, you might be able to recover compensation through your own uninsured/underinsured motorist coverage, by pursuing the at-fault party’s personal assets, or through other liable parties (such as an employer in a work-related accident).
The timeline varies depending on the complexity of your case, the severity of your injuries, and whether the insurance company offers a fair settlement or if we need to file a lawsuit. Some cases settle in a few months; others may take a year or more, especially if litigation is necessary. We’ll give you a realistic timeline during your consultation.
Car Accident Questions
First, seek medical attention for yourself and others. Call 911 to report the accident. If possible, take photos of the scene, vehicle damage, and any visible injuries. Get contact information from witnesses. Avoid discussing fault or apologizing at the scene. Contact a personal injury lawyer as soon as possible.
Yes. Most insurance policies require you to report accidents promptly, even if you weren’t at fault. However, be careful about what you say. Provide only basic facts—don’t speculate about fault or downplay your injuries. It’s best to consult with a lawyer before giving a recorded statement.
This is common. Many injuries including whiplash, back injuries, and traumatic brain injuries—don’t show symptoms immediately. This is whyit’s critical to see a doctor right away after any accident, even if you feel fine. Document all injuries and seek medical attention as soon as symptoms appear.
Yes. Accidents on private property, including parking lots, are still subject to personal injury law if someone else was negligent. These cases can be complex because fault can be less clear, but an experienced attorney can investigate and build a strong case.
Truck Accident Questions
Truck accidents involve multiple potentially liable parties (the driver, trucking company, cargo loaders, maintenance companies), complex federal regulations, severe injuries due to the size of commercial vehicles, and much larger insurance policies. These cases require specialized knowledge and resources
We investigate by obtaining the driver’s logs, maintenance records, black box data, and company compliance records. Common violations include hours-of-service violations (driver fatigue), inadequate vehicle maintenance, improper cargo loading, and unqualified drivers.
Often, both. Trucking companies can be held liable for negligent hiring, inadequate training, failure to maintain vehicles, pressuring drivers to violate safety regulations, and other corporate negligence. This is why truck accident cases often result in much larger settlements than typical car accidents.
Slip and Fall Questions
It depends. To have a valid premises liability claim, we must prove the property owner knew or should have known about the dangerous condition and failed to address it or warn you. For example, if you slipped on a wet floor without a warning sign, and the spill had been there long enough that employees should have noticed it, you likely have a case.
This is a common defense. However, property owners have a duty to maintain safe premises. If a hazard wasn’t obvious or was hidden, you may still have a valid claim even if you could have theoretically avoided it. We’ll investigate the circumstances and fight back against victim-blaming tactics.
Property owners must act within a “reasonable” time after becoming aware of a hazard. What’s reasonable depends on the severity of the danger and how easily it can be fixed. At minimum, if they can’t fix it immediately, they should warn visitors of the hazard (e.g., with warning signs or barriers).
Wrongful Death Questions
Texas law limits wrongful death claims to the deceased’s spouse, children, and parents. If they don’t file within three months, the executor of the estate can file on their behalf.
Eligible survivors can seek compensation for loss of financial support, loss of companionship and guidance, mental anguish, funeral expenses, medical bills from the final injury, and more. In cases of gross negligence, punitive damages may also be available
Yes. The two-year statute of limitations begins on the date of death, not the date of the accident. However, it’s important to act quickly to preserve evidence and protect your rights.
Immigration-Related Questions
No. Under Texas law, you have the right to pursue compensation for injuries regardless of your immigration status. Your claim is a civil matter and should not trigger immigration enforcement.
Yes. You can recover damages for medical expenses, pain and suffering, and other losses. While lost wages can be more complicated, you still have rights and options.
Generally, no. Personal injury claims are civil matters, not criminal ones. However, every situation is unique. During your confidential consultation, we can discuss your specific concerns and ensure your personal injury claim is handled in a way that protects your interests.
